An Indiana man was sentenced today to between 27 months and 10 years in prison in the killing of a toddler who was smothered to death in March 2012.
Shawn Anderson-Holmes, 28, admitted in October to placing a pillow over the face of Colby Jozefczyk, his girlfriend's 16 month-old, and trying to make it look like an accident, Indiana County District Attorney Patrick Dougherty said.
Anderson-Holmes was originally charged with criminal homicide. He pleaded guilty to involuntary manslaughter.
"Upon reviewing all the facts and circumstances, we felt that it was appropriate to enter a plea to involuntary manslaughter, which is a felony of the second degree," Mr. Dougherty said. "The victim's family was consulted and is in agreement on that."
Mr. Dougherty said that the involuntary manslaughter charge is appropriate because there wasn't evidence that the killing was intentional or premeditated.
"He took responsibility for taking the life of [the child]," Mr. Dougherty said. "... Everyone involved in the system was satisfied with the outcome."
Anderson-Holmes' attorney could not be immediately reached for comment.
