A two-year-old lawsuit in which a Saxonburg man faulted Butler County Prison officials for a brain injury he suffered in the lock-up has been dismissed with the consent of the plaintiff, according to court filings.
Devon Kuhn, 37, had sued the county and several prison officials, claiming that he had been arrested in 2009 for attempted bike theft only to leave the facility by ambulance the next day with a massive brain bruise.
The complaint accused corrections officers of "savagely beating" him but acknowledged that Mr. Kuhn had no memory of the events.
County staff said he hurt himself.
Mr. Kuhn's attorney, John Smarto, filed a stipulation to dismiss the case on Wednesday, and U.S. District Judge Cathy Bissoon closed the case today. Mr. Smarto has not been available for comment.
The county's attorney, Marie Milie Jones, wrote in an email response to questions that Mr. Kuhn voluntarily dismissed the case and there was no settlement.breaking - region - neigh_north
