Kittanning man charged in 2012 crash on Route 28 that killed Aspinwall boy, 6

Pennsylvania State Police said today they have charged a Kittanning man in the May 2012 death of a 6-year-old boy in a crash on Route 28 in O'Hara that also injured his parents and 4-year-old brother.

Kirk A. Fair, 39, is charged with homicide by vehicle, three counts of aggravated assault by vehicle, four counts of recklessly endangering another person, one count of involuntary manslaughter and traffic offenses.

About 7:30 p.m. on May 1, 2012, a 2004 Pontiac Vibe carrying O'Hara Elementary School first-grader Elijah Straw and his family pulled over to the shoulder on Route 28 northbound.

A Ford pickup with Mr. Fair at the wheel slammed into to the Vibe, sending both off the road and into a grassy median.

Elijah died at Children's Hospital of Pittsburgh of UPMC. His brother, Rowan, was listed there in critical condition after the crash.

Their mother, Jennifer, 38, and father, Tom, 42, who was driving the car, were injured and taken to UPMC Presbyterian, although at the time of the crash state police described their injuries as moderate.
