No reduced sentence for 'sex-slave' convict

Scott Tyree, who is serving nearly 20 years in prison for taking a 13-year-old Crafton Heights girl with him to Virginia to be his sex slave, hoped yesterday that a judge would cut his sentence in half.

It didn't happen.

To the delight of the girl's parents and the U.S. attorney's staff, Senior U.S. District Judge William Standish re-sentenced Tyree to the same term he imposed in 2003 -- 19 years and seven months.

Describing Tyree's behavior as "deeply troubling," Standish rejected his lawyer's argument that Tyree should receive only 10 years in jail because the girl was a willing sadomasochistic participant who had asked to be held captive and abused.

After the decision, U.S. Attorney Mary Beth Buchanan hugged the girl's parents as federal marshals escorted a shackled Tyree, 41, out of the courtroom and back to jail.

The new sentencing hearing was necessary because of a recent U.S. Supreme Court decision. While Tyree's appeal of his sentence was pending, the high court ruled that federal sentencing guidelines are advisory, not mandatory.

"This case is about a grown man and a 13-year-old girl agreeing to engage in sex," said Tyree's lawyer, R. Damien Schorr. "He thought he was going into consensual relationship."

Assistant U.S. Attorney Tina Miller said Tyree deserved the 20-year term because "this is a very heinous crime. This is someone who kept someone captive in his home for four days."

She also said Tyree was a risk for recidivism and noted that Tyree has filed a motion in federal court in Virginia to force the government to return his whips, chains, dog collars and other S&M items.

The girl disappeared from her Crafton Heights home on New Year's Day, 2002. Her parents found her three days later in Tyree's townhouse in Herndon, Va. Tyree had trolled Internet chat rooms looking for a girl to make his sex slave.
