Oakland: Magee-Womens sued

Five more families have sued Magee-Womens Hospital in connection with the handling of deceased babies and fetuses by a former McKeesport funeral director.

Nineteen babies and more than 300 fetuses were found a year ago in the garage of Robert B. Winston, who had been hired by the hospital from 1999 to 2002 to take the remains to a facility in Ross for cremation.

The first civil lawsuit was filed in Allegheny County Common Pleas Court by attorney Henry H. Wallace in June. Plaintiffs Joseph and Valerie Orbovich charged Magee with breach of contract, corporate negligence, interference with a dead body and negligent retention of a contractor.

Four lawsuits were filed yesterday and another last month, all with Mr. Wallace as the plaintiffs' attorney.

Mr. Winston has been charged criminally with theft by deception and 19 counts of abuse of a corpse and is awaiting trial.
