2 deported in cases tied to ruling on Obama policy

 

Two illegal immigrants were sentenced Wednesday to time served and deported in cases that were initially affected by a judge’s ruling that President Barack Obama violated the Constitution by issuing an executive order delaying deportation for millions of illegal immigrants in the U.S.

Salvador Lopez-Santiz and Marco Garcia-Caseras were charged with illegally entering the U.S. after having been deported. Such cases are routine in U.S. courts.

U.S. District Judge Arthur Schwab gave them both time served and ordered them turned over to immigration authorities for deportation. In a similar case, United States v. Elionardo Juarez-Escobar, he had ruled that the president cannot use his executive powers to bypass Congress. In all three cases, the judge had asked that the parties file briefs on how the president’s order would affect the prosecutions.

In all three, however, lawyers on both sides said the president’s action would have no effect because the executive order does not apply to criminal cases.
