A Montgomery County man who was shot and wounded during an alleged knife-point robbery at an Ingram convenience store was ordered today to stand trial.
At a preliminary hearing this morning, District Judge Dennis Joyce dismissed a count of attempted homicide against the suspect, Lawrence V. Davis, 20, of Norristown.
Mr. Davis will face trial on charges of aggravated assault and robbery.
Police said Mr. Davis, armed with a knife, entered the 7-Eleven store on Christmas morning and attacked the clerk, Kaelin Weber.
Mr. Weber, 24, who was licensed to carry a firearm, pulled the weapon and fired at his attacker, wounding Mr. Davis.
District Attorney Stephen A. Zappala Jr. this week said his office would not prosecute Mr. Weber in connection with the shooting. Mr. Zappala determined the clerk was justified in pulling the weapon and shooting the suspect.
However, Mr. Weber's license to carry the weapon has been revoked in the wake of a recent incident in which he brandished the gun in a confrontation with a customer over change during a transaction.
Mr. Davis remains jailed on $100,000 bail.
