Woman abducted at Waterworks Mall sues

Lawyers for a Fox Chapel woman who was abducted in April from Waterworks Mall and taken to Ohio, where she was raped, have filed a lawsuit against the mall's owners, claiming a lack of security measures that could have prevented the incident.
In a civil suit filed yesterday in Allegheny County Common Pleas Court, the woman and her husband, identified only as John and Jane Doe, are seeking more than $25,000 in damages from J.J. Gumberg Co.
"Gumberg knew that the Waterworks Mall attracted an unusually high incidence of crime, yet Gumberg failed to take action in compliance with its legal obligations to its customers," the lawsuit states.
Police have charged Jimmy Lee Tayse, 30, of Johnstown, with abducting the woman, who was with her toddler daughter, at knifepoint, and taking them to Ohio.
The couple's lawyers said Mr. Tayse was "loitering in the mall and was allowed by Gumberg to remain in the mall without regard to the safety of its customers."
Gumberg officials could not be reached for comment last night.
