State senator sues over NCAA use of Penn State fine

A state senator on Friday filed a lawsuit asking the Commonwealth Court to stop the NCAA in its plan to spend proceeds from a $60 million fine against Penn State University on child-abuse groups around the nation.
The state lawsuit is unrelated to the suit Gov. Tom Corbett announced this week asking the federal courts to throw out the NCAA sanctions resulting from the Jerry Sandusky child sex abuse case. The fine is one of several NCAA sanctions Penn State agreed to in July.
In the new suit, Sen. Jake Corman, R-Centre and chairman of the Appropriations Committee, argues the NCAA plan for the fine would violate state appropriations laws.
Mr. Corman said in late December that he would introduce legislation to limit proceeds from the fine to Pennsylvania organizations. He said he would file a lawsuit to prevent the NCAA from acting before his proposal could become law.
The university has set aside the first $12 million installment of the fine while an NCAA task force establishes an endowment.
