Curley, Schultz ask to be tried separately

Two former Penn State administrators have asked that they be tried separately on charges related to the Jerry Sandusky sex abuse scandal.
Former athletic director Tim Curley and former vice president for business and finance Gary Schultz each filed motions Monday asking a Dauphin County judge to allow their cases to be severed.
Each man is charged with one felony count of perjury and a summary offense of failing to report suspected child abuse. Trial is scheduled for Jan. 7 in Harrisburg.
In their supporting briefs, defense attorneys for the men argue that trying their clients together would be prejudicial.
Tom Farrell, who represents Mr. Schultz, wrote that neither of the men's perjury counts arise from the same act as is required to join.
In addition, Mr. Curley's attorney, Caroline Roberto, argues that the two counts against the defendants should also be heard separately. She wrote that the evidence on the perjury charge would not be admissible in the failure to report case, and vice versa.
