Highmark files dismissal motion on UPMC ad lawsuit

One of the legal entanglements involving Highmark and UPMC -- the insurer's false advertising complaint against the health care system -- is ending.

Highmark filed a motion to dismiss the lawsuit Monday, following through on one of the pledges it made in a May pact that gives the insurer's subscribers access to UPMC's doctors and hospitals through 2014. The lawsuit had maintained that UPMC's "Keep Your Doctor" ad campaign was false.

The dismissal motion calls for each side to pay its own legal bills and costs.

Still active are West Penn Allegheny Health System's antitrust case against UPMC, and UPMC's antitrust case against Highmark, as well as private developer Royal Mile Co.'s conspiracy case against both Highmark and UPMC. Royal Mile filed a motion Monday telling the court that it is in settlement talks with Highmark.
