Man jailed in shooting of 12-year-old brother

Uniontown police arrested a 19-year-old man late Sunday, saying he shot his 12-year-old brother in the stomach.

David D. Brooks, of California, Pa., is charged with aggravated assault and carrying a firearm without a license, both felonies, in connection with the shooting that wounded his brother, Timothy.

Mr. Brooks also is charged with two counts of misdemeanor simple assault and misdemeanor reckless endangerment.

In a criminal complaint, Uniontown police Detective Donald M. Gmitter said that Mr. Brooks, who was taken into custody immediately after the shooting, told police that he was at his father's house on South Vernon Street when he pulled his gun out of his pocket. Mr. Brooks told police the gun fired, striking Timothy in the stomach. He then threw the gun away in a nearby creek, he told police, though they never found it.

Timothy was flown to Children's Hospital of Pittsburgh of UPMC. He was in fair condition, hospital spokeswoman Andrea Kunicky said.

Mr. Brooks was arraigned Monday, and bail was set at $50,000. He remained in the Fayette County Prison.

A preliminary hearing is scheduled for Oct. 9.
