An Allegheny County Common Pleas judge charged in December with drunken driving in Mt. Lebanon has entered a program for first-time offenders that, if completed successfully, means his record would be expunged.

Mt. Lebanon police stopped Judge Randal Todd, 56, on Dec. 16 after an officer watched him back into another vehicle at Shady Drive West and Washington Road, not far from the police station.

An officer wrote in a criminal complaint that he smelled alcohol on the judge's breath and noticed that he struggled to maintain balance before failing field sobriety tests.

A preliminary hearing on two misdemeanor counts of driving under the influence and a summary traffic citation was scheduled for today, but Judge Todd instead entered the Accelerated Rehabilitative Disposition program on Jan. 27, his attorney Robert Del Greco said.

The charges will be expunged from his record if he completes the program and does not reoffend. At the time of his arrest, Judge Todd chose not to hear criminal cases pending the outcome of his case and was reassigned to the civil division.
