Rankin ex-chief loses lawsuit against county

Former Rankin police Chief Darryll Briston's effort to sue Allegheny County for a 20-day imprisonment in 2007 was tossed Friday by U.S. District Judge David S. Cercone.

Mr. Briston was convicted in 2004 on federal theft charges for taking $5,855 that had been seized in the search of a home in 2002. He alleged that the county and its officials had failed to release him immediately at the end of his 37-month sentence. Judge Cercone, though, found no evidence of "willful misconduct," and therefore no way for Mr. Briston to overcome the county's general immunity from liability.
