Former Penn Hills employees sue over termination

Two former Penn Hills employees who said they were terminated ostensibly because they violated the residency requirement filed a lawsuit in U.S. District Court today claiming that their firings violated their rights to due process, equal protection and free speech.
Mary Lou Flinn, 62, and Joseph A. Probo, 58, both former code enforcement officers, list current Monroeville addresses on the complaint filed by attorney James W. Harvey. Ms. Flinn sometimes stayed with her daughter outside of Penn Hills to help care for two autistic grandchildren, the complaint said. Mr. Probo sometimes spent nights at his wife's home in Monroeville, it said. But both leased property in Penn Hills, it said.
It said that Penn Hills has periodically tried to enforce a requirement that its employees live within its borders. It said that the residency requirement is being inconsistently applied in ways that violate agreements with unions.
Named as defendants are the municipality and its Manager Mohammed Ryan. Penn Hills Mayor Anthony DeLuca Jr. could not be immediately reached for comment.
