Oral arguments scheduled in Cyril Wecht appeal

The 3rd U.S. Circuit Court of Appeals has tentatively scheduled oral arguments on the Cyril Wecht appeal for July 25 in Philadelphia.
The former Allegheny County coroner was tried on 41 counts of mail and wire fraud and theft of honest services earlier this year. The 11-person jury was unable to reach a unanimous verdict, however, and U.S. District Judge Arthur J. Schwab declared a mistrial on April 8.
Dr. Wecht's attorneys have filed an appeal with the 3rd Circuit arguing that a retrial of the charges would constitute double jeopardy because Judge Schwab did not follow the proper procedures in declaring the mistrial.
