Court orders Carrick man resentenced on DUI conviction

A Carrick man ordered to spend seven to 15 years in prison on his 14th and 15th convictions for driving under the influence must be resentenced.
The state Superior Court on Monday issued a non-precedential opinion finding that the judge who sentenced Richard Caporal failed to address his eligibility for the Recidivism Risk Reduction Incentive program, which allows a defendant to serve less time in prison.
Because of that, the court has ordered Allegheny County Common Pleas Judge David R. Cashman to resentence Caporal, 58, and address two additional issues raised in his appeals.
Caporal attempted to plead guilty and agreed to a 2 1/2 to five-year prison term, but Judge Cashman rejected it, saying the sentence was too lenient.
At his sentencing on June 23, 2011, Judge Cashman called Caporal a "terrorist" because of his 34-year history of drunken driving.
