The 3rd U.S. Circuit Court of Appeals has set oral argument in the ongoing criminal case involving former Allegheny County Coroner Dr. Cyril H. Wecht for Aug. 4.

A three-judge panel will hear the argument in Pittsburgh.

Dr. Wecht is charged with 41 felony counts that he received private financial gain through his public office. He was tried on the charges earlier this year, but the case ended with a hung jury in April.

The defendant's attorneys filed an appeal with the 3rd Circuit, alleging that if their client is retried, it would be unconstitutional double jeopardy.

U.S. District Judge Arthur J. Schwab rejected that argument, but the 3rd Circuit stayed the retrial of the case pending a decision on the appeal.
