False prosecution suit against city thrown out

A false prosecution lawsuit stemming from an arrest in a 2006 shooting near Westinghouse High School was tossed out by U.S. District Judge David S. Cercone today.
Brandon Murray, 23 at the time, was one of two men arrested in the shooting of Aaron Henderson, and was acquitted at a non-jury trial in 2007. He sued the city of Pittsburgh and eight of its officers, alleging unreasonable seizure and malicious prosecution.
Judge Cercone found "no evidence that the officers in this action knowingly provided false information to the prosecutor" nor any reason to believe that they "exhibited actual malice or engaged in willful misconduct with regard to his arrest and prosecution."
The other defendant, Thomas Beck, was declared guilty of aggravated assault in the shooting.
