Lawn company fined for wastewater discharge

EG Systems of Marysville, Ohio, owner of Scotts Lawn Service in

Monroeville, has agreed to pay a $160,000 penalty to settle charges

stemming from the intentional discharge of up to 1,000 gallons of

wastewater into Thompson Run in June 2010.

The wastewater contained high levels of herbicides, pesticides and

fertilizer.

The state Department of Environmental Protection said today that investigators, responding to complaints of odors, discovered that a Scotts employee had built a syphon system to drain an 8,000-gallon holding tank directly into a storm sewer that connected to the stream.

DEP's investigation found eight violations of the state's Solid Waste

Management Act and its Clean Streams Law. The fine will be paid to the

state's Clean Water Fund, which is used to address pollution problems.

Scotts hired a environmental contractor to do remediation work on the

stream.

In a separate action, the Pennsylvania Office of Attorney General

reached a settlement on criminal charges against the employee. He is

required to serve two years of probation, pay a $2,500 fine and perform 40 hours of community service.
