Allegheny County Common Pleas Judge David R. Cashman agreed after an emergency bail hearing Friday to release a former top homicide prosecutor charged with promoting prostitution.
Defense attorney Patrick Thomassey said he expected his client, W. Christopher Conrad, 64, to leave his holding cell later Friday afternoon.
Mr. Conrad was arraigned Thursday on one count each of promoting prostitution, criminal conspiracy and possessing an instrument of crime.
Mr. Thomassey called the situation involving Mr. Conrad, the county's former top homicide prosecutor, "sad."
"He's been fighting his alcohol addiction for a number of years," Mr. Thomassey said. "But we're working on it."
During an undercover operation, a Moon police detective began to arrest a woman they identified as a prostitute when she told him that her attorney, Mr. Conrad, was in the parking lot. The woman told police Mr. Conrad drove her to the appointment and was waiting for her in the parking lot of the Days Inn in Monroeville.
She cooperated with police detectives and called Mr. Conrad, who had gone to the Gateway Grill across the street. Detectives arrested Mr. Conrad as he left the restaurant.
Mr. Conrad told a Monroeville police detective he suspected she meets men as an escort and was waiting for her call.
Assistant District Attorney Jon Pittman said that not only was Mr. Conrad promoting prostitution, he was also driving on a suspended license. Mr. Conrad has been convicted of drunken driving three times and has two additional pending DUI cases.
Mr. Thomassey said there was no proof Mr. Conrad had driven the woman to the hotel for her appointment.
Mr. Thomassey said the woman had driven the vehicle and that Mr. Conrad had simply walked across the street to the Gateway Grill to wait for her.
Mr. Conrad's license remains suspended until November 2014 and his license to practice law in Pennsylvania was suspended in August 2012 for two years.
He left the district attorney's office in 1998 to work as a defense attorney.
