Officer found not guilty of indecent assault charge

A Pittsburgh police officer was acquitted Thursday of indecent assault and other charges stemming from a 2007 incident at a woman's home in Sheraden.

An Allegheny County Common Pleas Court jury deliberated less than three hours and found Officer Dewayne Hart not guilty.

On Dec. 7, 2007, Officer Hart went to the woman's house to take a burglary report from her and left. According to an affidavit, Officer Hart returned a few minutes later, telling the woman that she was wanted on an outstanding arrest warrant.

The woman later told police that Officer Hart said he could take her to jail, and then he touched her breasts and forcibly placed her hand on his pants, the affidavit said. The officer told her he would be back to take her to jail the next morning and left her house. The woman ran to a neighbor's house and then went to her sister's where she called 911 and reported what happened.

The Post-Gazette does not name alleged victims of sexual assault.

Officer Hart's attorney, William Difenderfer, said the victim's story was filled with inconsistencies. He said Officer Hart was being sympathetic to the victim after he learned she was caring for two children and did not take her immediately to jail.

Deputy District Attorney Janet Necessary said Officer Hart was commanded by the warrant to take the victim into custody immediately.

"He wanted something from her: sexual favors," she said.

She said it made no sense for the woman to fabricate the story. "Why would she make up a story against someone who was trying to keep her out of jail?"
