Doctor wins suit against cancer institute over retaliation

A radiation oncologist who formerly worked for the University of Pittsburgh Cancer Institute today won a multi-million dollar verdict in her federal suit.

Kristina Gerszten, who worked for the cancer institute from 1992 to 2007, was awarded $200,000 in compensatory damages, $500,000 in punitive damages, as well as $1.5 million in back pay and more than $1.4 million in front pay.

She filed a federal lawsuit against the University of Pittsburgh Cancer Institute in September 2008, claiming both sex discrimination and retaliation.

A jury before U.S. District Judge Arthur J. Schwab today ruled that there was no sex discrimination, but that the medical facility did retaliate against Dr. Gerszten after she complained about sex discrimination. The jurors also found that she did not get the job as medical director at St. Margaret Hospital/Natrona Heights because of retaliation.
