Sisters of boy who drowned in septic tank returned to parents
Thursday, November 12, 2009

Beaver County Children and Youth Services has returned two children to their parents' custody more than two months after the girls' younger brother drowned in a septic tank.

A Pittsburgh attorney representing John and Terri Smitsky went to Beaver County last Friday to request a decision on the girls' status.

The Smitskys' 4-year-old son, Wyatt, was found dead in the bottom of the septic tank after he disappeared from a family gathering Sept. 4.

Beaver County Coroner Teri Tatalovich-Rossi ruled the cause of death as drowning. No ruling has been made as to whether the death was an accident.

A day after the boy was reported missing, CYS officials ordered the boy's sisters, Tallylynn and Paige, removed from the home.

The children's paternal grandparents were given temporary custody and the girls' parents were granted visitation.

On Monday afternoon, the Smitskys got clearance from CYS to regain custody of the girls, with conditions.

The couple had to agree to in-home services by CYS and counseling for them and their daughters.

The county will pay for the counseling, said Joseph Horowitz, the Smitsky's attorney.
