The Education Law Center says it intends to sue Carlynton School District and the state Department of Education over the enrollment of four homeless children.
The center says it will file the lawsuit in U.S. District Court in Pittsburgh, alleging violations of a federal law protecting treatment of homeless children.
The center says the children, identified only by their initials, are being served by a homeless shelter that's located in the district.
The children are enrolled in Carylynton schools now, but the district wants them out, claiming they're not district residents, and state officials have backed up the district's argument, the center says.
State Education Department spokesman Michael Race was not immediately able to comment.
School district Superintendent Michael A. Panza said although the children are served by a day shelter in the district, they're sleeping at churches outside of the district.
