Baumhammers' parents pay to settle civil lawsuit

Nine years after Richard S. Baumhammers went on a racially motivated killing rampage, the civil court saga came to an end last month with a quiet settlement paid out from the killer's family to those of his six victims.

Mr. Baumhammers, who turns 44 tomorrow, is on death row for the April 2000 shooting deaths of Anita Gordon, 63, of Mt. Lebanon; Anil Thakur, 31, of Bihar, India; Ji-Ye "Jerry" Sun, 34, of Churchill; Thao Q. Pham, 27, of Castle Shannon; and Garry Duane Lee, 22, of Aliquippa; and for injuring Sandip Patel. The 32-year-old Ross man died in 2007 from complications related to quadriplegia.

Parents Andrejs and Inese Baumhammers agreed to pay each family of the deceased a little more than $130,000, a total of $785,000 to put the case to rest. Richard Baumhammers was living in Mt. Lebanon with his parents at the time of the killings.

Attorneys initially sought a total of $31 million from two insurance companies that had provided the Baumhammers family with accident insurance.

But in 2002 Common Pleas Judge Eugene B. Strassburger III ruled that the United Services Automobile Association policy did not cover murders, and last year, the Pennsylvania Supreme Court found that Donegal Mutual Insurance had to pay only one $300,000 claim, rather than six claims for separate shootings.

Those rulings meant that the victims were seeking money primarily from two dentists rather than large insurance companies. Consequently, "you have to take less than what the case is worth," said James J. Ross, who represented Mr. Lee's family.

The resolution, Mr. Ross said, was difficult and lengthy because of the appeals process with the insurance companies and because each victim's case had to be approved by Orphans Court because it involved estates. Mr. Ross' case had the additional hurdle of going through Beaver County Orphans Court because Mr. Lee was killed in Center Township.

According to court filings, the parties agreed to the settlement in February and the case was closed April 24, after the payments had been made.
