Butler doctor held for court on sexual assault charges
Tuesday, May 12, 2009

A prominent Butler doctor and former Boy Scout troop leader was held for court yesterday after two adult brothers testified that he molested them when they were teenage Scouts nearly 20 years ago.

Dr. David Allen Evanko, 55, is free on bond pending trial on charges of involuntary deviate sexual intercourse and other offenses.

The brothers, now 31 and 28, said Dr. Evanko plied them with alcohol and gay porn movies and then sexually abused them at his sister's house in Butler, in his camping trailer and in pup tents at area campgrounds and on vacations to the New Jersey shore and other locations from 1990 through 1993.

The Pittsburgh Post-Gazette does not name victims in sex cases.

District Judge Pete Shaffer heard nearly three hours of graphic testimony from the two men while Dr. Evanko sat stoically at the defense table, holding his wife's hand.

The doctor left without comment, but his lawyer, David DeFazio, characterized the accusations as lies motivated by a potential payoff. He questioned why it took so long to bring the accusations and said he wonders if the brothers, one of whom has a criminal record for theft and selling drugs, will eventually file civil suits against the doctor.

"I'm suspicious that there's money involved," he said.

In court, Mr. DeFazio attacked the brothers' inability to remember dates, times or even in some cases years for the sex acts they said Dr. Evanko committed.

The older brother said the abuse started when he was about 13 and ended when he was 16. He said it started when Dr. Evanko answered his questions about sex, then progressed to showing him gay porn and caressing him. Eventually, he said, they had sex. He also said at one point another of his brothers performed oral sex on him at Dr. Evanko's encouragement.

Sometime later, he said, he accompanied Dr. Evanko to Pittsburgh, where they picked up a 25-year-old male prostitute to have sex with the boys.

He also said Dr. Evanko once had anal sex with him.

"It's a pretty stark memory," he said. "It's not something that you really forget."

But he couldn't provide a date.

The younger brother, now a cab driver in Portland, Ore., said that Dr. Evanko performed oral sex on him at least 100 times in Butler County and on trips to Wildwood, N.J., Cleveland, Philadelphia and other cities.

He said he first met the doctor at age 13, when he joined the Boy Scout troop where his brothers were members. One of Dr. Evanko's tactics, he said, was a "truth or dare" game that he said usually ended in sex, typically after hours of drinking.

He said his brothers, one of Dr. Evanko's foster sons and several other boys were also present when the sexual acts went on.

The boys all looked up to Dr. Evanko, he said, and feared his disapproval.

"He was kind of like a father figure," he said. "A disciplinary figure."

Mr. DeFazio said the doctor is still practicing medicine. The Boy Scouts of America has revoked his membership.

The case, which is being prosecuted by the state attorney general's office, began when troopers interviewed the older brother on March 16 after he approached Butler County Children and Youth Services. They talked to the younger brother on March 22.
