Passed-out, parked driver charged with DUI

When you're passed out behind the wheel of a parked pickup truck whose engine is still running, it's quite possible you'll attract the attention of police.

That's what happened to David Babyak, 22, of Avonmore, Westmoreland County, on Wednesday morning in Washington Township, Westmoreland County.

According to state police, Mr. Babyak was passed out behind the wheel of a Chevrolet pickup truck parked in the 200 block of Mamont Road at 9:35 a.m. The vehicle's motor was running.

Police said a strong odor of marijuana emanated from the vehicle and Mr. Babyak told a trooper he had been smoking marijuana and taking prescription pain pills.

Mr. Babyak was charged with driving under the influence and was taken to Westmoreland Hospital where he consented to a blood test.

In the vehicle in plain view, police said, was a "blunt" filled with marijuana, a pipe containing the drug and a white pill.
