The state Superior Court this week ruled that a former member of the Duquesne University basketball team who was wounded nearly two years ago in an on-campus shooting can proceed with his lawsuit against the school.
The suit was filed in April 2007 by Stuard Baldonado, a 6-foot-7-inch transfer from a Florida junior college who never played a game for the Dukes. He entered the university in the fall of 2006.
That September, he and four other players were wounded in a shooting by two men who were not students but who had attended a back-to-school dance on campus.
The university initially appealed a Common Pleas Court ruling that Mr. Baldonado had a right to sue.
The university appealed that decision to the Superior Court, which on Wednesday declined to review the lower court ruling.
