It's back to jail for former state Rep. Habay

Former state Rep. Jeff Habay will report to Allegheny County Jail today.

Mr. Habay, 42, of Shaler, has four months remaining on his concurrent sentences, which have been delayed by a lengthy appeals process, but the two judges who imposed them disagree on where they should be served.

On July 16, Judge Lester G. Nauhaus ordered Mr. Habay to go to jail, starting today, to serve out the sentence. Last week Common Pleas Judge Jeffrey A. Manning ruled he could spend that time in a halfway house or, if Judge Nauhaus saw fit, under house arrest.

But Judge Nauhaus did not hear any new motions from Mr. Habay and is out of town this week.

Mr. Habay was convicted in 2005 on charges of forcing staffers to do campaign work on state time and sentenced to six to 12 months in jail by Judge Manning. He pleaded no contest in April 2007 to charges of false statements to police, in which he claimed a political opponent had mailed him anthrax, and was sentenced to four to eight months in jail by Judge Nauhaus, to run concurrent to Judge Manning's sentence.

This will be Mr. Habay's second trip to the county jail. He spent about a week there in 2006 before a spot opened up for him in a halfway house, where he spent about two months.

Mr. Habay was under house arrest with an electronic monitoring device for nearly two years during his appeal process. On July 2 the state Supreme Court declined to hear his appeal on the 2005 corruption conviction.

Mr. Habay's lawyer, Patrick Thomassey, said he would report to the courthouse this morning, then be taken to the county jail. Mr. Thomassey said he would file a motion to get Mr. Habay moved from the jail to the Goodwill halfway house where he served before.

Judge Nauhaus will hear motions when he returns Aug. 11, so Mr. Habay will spend at least 10 days in jail.
