A Pennsylvania state constable was ordered to stand trial yesterday for allegedly molesting a 14-year-old boy in the parking lot of a McDonald's restaurant in Shaler.
Brian Scott Franklin, 33, of Carrick, faces charges of endangering the welfare of a child, corruption of minors and two counts of indecent assault.
According to a criminal complaint, Mr. Franklin took the accuser and another 14-year-old on July 8 to shop and see a movie. Later in the evening they pulled into the drive-through lane at the McDonald's restaurant on Route 8.
Mr. Franklin then reached toward the back seat, where the boy was sitting, and touched the boy's genital area for about 30 seconds, the complaint said. The boy protested, but Mr. Franklin told him to "shut up" because he was buying his meal.
After ordering food, Mr. Franklin parked the car in the restaurant's lot. He again reached behind him and touched the boy's genitals, the complaint said. He then took the boy home.
According to the complaint, the boy said he feared Mr. Franklin because, as a constable, he is authorized to carry a gun.
District Judge Robert P. Dzvonick yesterday decided there was sufficient evidence to send Mr. Franklin's case to trial.
Mr. Franklin has been released on his own recognizance, but he is prohibited from having contact with his accuser. He faces a formal arraignment on Sept. 29.
