Teen who sold drug to girl who died placed on probation

A New Castle teenager has been placed on probation for selling oxycodone to a classmate who later died.

Joshua Stewart, 17, will be on probation at least until his next birthday. He also could remain under court supervision until he is 21, one of his lawyers, Keenan Holmes, said this morning.

Lawrence County Common Pleas Judge John Hodge convicted Mr. Stewart after a bench trial in March. Judge Hodge also imposed the sentence.

Judge Hodge convicted Mr. Stewart of selling oxycodone to Erica Million, 16, in February 2007. Prosecution witnesses said the drug deal occurred in a Spanish class at New Castle Senior High School.

Ms. Million collapsed the same day in a math class. She died at Children's Hospital in Pittsburgh.

Mr. Stewart said he is innocent. He said he was framed by two students who testified against him.

Expelled from New Castle High, he is studying one day a week at another school.

Still ahead for Mr. Stewart is a civil case. Ms. Million's family has filed suit against him for wrongful death.
