Anyone who used a credit or debit card at any of the Big Burrito's restaurants about a year ago may be entitled to a $7 gift card to Mad Mex.
The gift cards are part of a settlement in a class-action suit that covers all of the Big Burrito restaurants, which include Eleven, Kaya, Casbah, Cafe Phipps, Warhol Cafe, Soba, Umi, Big Catering and Mad Mex.
The suit claimed that the chain had violated the Fair and Accurate Credit Transactions Act by printing electronically either full ccard numbers or expiration dates on customer receipts. All of the restaurants are included during the period of December 2006 until March 2007. Cafe Phipps is covered from January 2005 until Dec. 7, 2007, and Mad Mex in Monroeville is covered from May 2006 until March 2007.
The chain denied any wrongdoing.
The settlement of the class action calls for all customers to receive a gift card good at Mad Mex. The lead plaintiff in the case, Thomas A. Reed Jr., will receive $2,500, and the attorneys will receive $105,000 for their costs and fees. Big Burrito also will donate $5,000 to Share Our Strength, a charity that fights childhood hunger.
