A Carrick High School art teacher has been charged by Upper St. Clair police with sexually assaulting a 17-year-old boy in June.
According to the affidavit of probable cause filed Monday at the office of District Judge Robert Wyda, the assault took place at the Upper St. Clair home of teacher Regis E. Kirby, 48, on June 18, but the victim did not come to police until Jan. 7.
Pittsburgh Public Schools spokeswoman Ebony Pugh said Upper St. Clair police made the district aware of the allegations early this month and that the district placed Mr. Kirby on paid leave during the police investigation.
"He has not been in the classroom since then," Ms. Pugh said. She confirmed that the alleged victim is a city school student, but couldn't say if he was one of Mr. Kirby's students at Carrick High.
Mr. Kirby was charged with two counts of involuntary deviate sexual intercourse, three counts of selling or furnishing liquor to minors and one count each of indecent assault, corruption of minors and terroristic threats.
He was arraigned before District Judge Richard Zollar. Bail was set at $25,000 and he was ordered to undergo an evaluation at the Allegheny County Jail behavior clinic.
Mr. Kirby faces a preliminary hearing before Judge Zollar at 1 p.m. Monday.
According to the affidavit, the victim told police that he, his 19-year-old brother and a cousin went to Mr. Kirby's Upper St. Clair home at about 1:30 a.m. on June 18.
He told police Mr. Kirby "greeted them with a beer in his hand" and then offered them some. All three eventually consumed multiple beers and other liquor that Mr. Kirby provided, according to the affidavit.
At some point everyone but Mr. Kirby and the victim fell asleep and then the victim curled up on a trampoline to fall asleep. The affidavit states it was then that the sexual assault occurred.
According to the affidavit, after the assault, Mr. Kirby told the victim "he would kill him if he told anyone about what had just taken place."
Mr. Kirby could not be reached for comment and Pittsburgh Federation of Teachers President John Tarka said he had no comment on the charges against Mr. Kirby.
Ms. Pugh said she had no further comment since the district had not been formally notified that Mr. Kirby had been charged.
