A Lower Burrell couple has filed a federal lawsuit, claiming that Martha Stewart dinnerware caused their two sons to get lead poisoning.
Sandra Jo and Raymond Dombrowski filed the lawsuit, alleging negligence, against Martha Stewart Living Omnimedia Inc. and Sears Holding Corp. yesterday.
In it, they claim their sons, Matthew and Michael, became ill from eating off the "Flowers and Buds Border" dinnerware purchased from Kmart in New Kensington in June 2001.
The Dombrowskis say they used the dishes until December 2006 and that they had an inherent design and manufacturing defect that allowed unsafe levels of lead to leach out.
The lawsuit contends that Matthew has lead poisoning, as well as mental, social and physical impairment, and a learning disability, because of the dishes.
Michael, the family alleges, had lead poisoning.
They are seeking an undetermined amount of both compensatory and punitive damages.
