The Pennsylvania Fish and Boat Commission's criminal investigation of the Norfolk Southern train derailment and chemical spill that killed countless fish on Sinnemahoning Portage Creek in June is in the hands of the district attorneys for McKean and Cameron counties, who will use it to determine which charges, if any, it will file against the railroad and/or others.
"It's part of our on-going investigation, like any police report," McKean district attorney John H. Pavloc said.
The Pennsylvania Department of Environmental Protection has levied more than $5 million in civil penalties against Norfolk Southern for the disaster that sent millions of gallons of lye into the trout stream and adjacent land. The railroad company is still engaged in cleanup operations.
Boat code change
Boat operators, including kayakers and canoeists, are now considered legally drunk with a .08 blood alcohol limit. The Pennsylvania General Assembly changed the Pennsylvania Fish and Boat Code, effective Jan. 1, to come into compliance with the Motor Vehicle Code. The previous limit was .10.
