A woman who was struck by a train while walking along tracks near her Jeannette home in January is suing Norfolk Southern Railway.
Patricia Frankhouser filed suit in Westmoreland County Common Pleas Court last week, saying the tracks near Seventh and Eighth streets have no gates or warning signs cautioning pedestrians against walking near the tracks, and no way of warning pedestrians of approaching trains.
A freight train moving along the heavily traveled tracks clipped Frankhouser on the shoulder and threw her to the ground. Court papers say she suffered a broken finger, cuts, scrapes and pain in her hands, arms and shoulder.
"The [engineer] did not stop the train in a timely manner, and failed to yield the right of way to a pedestrian walking along the tracks in plain view," the suit says.
The four-count suit asks for damages of at least $120,000.
