Pennsylvania State Police have charged a West Virginia man with homicide by vehicle in connection with a fatal June crash in German.

Edward Gilbert, 51, of Morgantown, also faces charges of reckless and careless driving and failure to stop at a red light.

State police said he crashed into Jacqueline Tremblay, of Adah, Pa., near the intersection of Route 166 and Route 21 on the morning of June 8.

Ms. Tremblay died at Uniontown Hospital after the crash.

A preliminary hearing is scheduled for April 30.

Mr. Gilbert's attorney, Joseph Fox, said, "It's going to be our position at the preliminary hearing that what this was was a very tragic accident and is more appropriate for disposition in civil court as opposed to criminal court."

Mr. Fox said police ran blood-alcohol tests and checked Mr. Gilbert's phone history and found no evidence that he had been drinking or inappropriately using his phone.
