An environmental group whose suit against Shenango Inc.’s coke battery on Neville Island was dismissed last week said it is considering an appeal.
U.S. District Judge Cathy Bissoon on Thursday dismissed the suit brought by the Group Against Smog and Pollution, which said Shenango continues to pollute the air despite a consent agreement between the plant’s owners, DTE Energy, and the Allegheny County Health Department.
Rachel Filippini, executive director of GASP, said Monday that the agreement doesn’t do enough to curb ongoing violations of the Clean Air Act.
In granting a motion to dismiss by Shenango, the judge ruled that it does because it requires a series of improvements to bring the plant into compliance.
Ms. Filippini said her group has until late April to decide whether to appeal.
