Veteran's family to receive $158,579 in VA hospital settlement

The family of a veteran who died of Legionnaires' disease at age 83 following a 2011 stay at the Veterans Administration's University Drive hospital in Oakland will receive $158,579 in a settlement approved by a federal judge today.

John Ciarolla was the first known fatal victim from the outbreak. The total of the settlement approved by U.S. District Judge Arthur J. Schwab is $227,500, including attorneys’ fees and costs.

The settlement was reached following an April mediation involving federal attorneys and families of four victims. The terms were not released at that time.

In all, 22 veterans were sickened during the outbreak in 2011 and 2012, and six of them died after contracting the disease at the Pittsburgh VA in Oakland. Many have sued the federal government, alleging negligence and wrongful death.
